TERMS AND CONDITIONS FOR THE SALE & SERVICE OF SECOND-HAND VEHICLES

1. Introduction

These Terms and Conditions (“Agreement”) govern the sale, purchase, and services related to second-hand vehicles by BUDGET CARS, a registered automobile dealership based in Bangalore. By purchasing a vehicle from or selling a vehicle to BUDGET CARS, the customer (“Customer”) agrees to be bound by the following terms.

These Terms and Conditions are subject to change without prior notice. Customers are advised to review the latest version at the time of purchase or service engagement to stay informed of any updates.

A signed invoice or delivery note will be considered as the customer’s formal acceptance of these Terms and Conditions. In addition, by visiting our showroom or using our website, you are deemed to have read and agreed to the Terms and Conditions published there.

If you require any clarification regarding the terms, our team is always available to assist and explain them before finalizing the purchase.

2. Vehicle Condition and Inspection
  • All vehicles are sold as seen, with the opportunity for the customer to inspect and test-drive the vehicle before purchase.
  • At BUDGET CARS, we provide basic details on each vehicle’s condition, service history (where available), and ownership background through our website. However, for customers visiting our site in person, our owners and sales representatives are available to offer complete, transparent, and personalized information based on your questions and requirements to support a confident purchase decision.
  • All vehicles sold by BUDGET CARS may exhibit normal wear and tear consistent with their age and mileage. While we strive to ensure transparency, BUDGET CARS does not guarantee that vehicles are entirely free from defects. Any known issues or visible defects are disclosed either on-site or through a phone conversation with our executives or the owner, upon request.
  • We thoroughly inspect all vehicles before handing them over to the customer and ensure that all known concerns are communicated clearly. However, some hidden defects may not be immediately visible at the time of sale. If a customer discovers any issues that were not previously mentioned, they are encouraged to contact us. We will be happy to guide and support them regarding the concern.
  • Customers are advised to inspect and test drive the vehicle before finalizing the purchase. We encourage customers to inspect the vehicle thoroughly, ask questions, and make an informed decision before completing the purchase.
  • All vehicles sold by BUDGET CARS are thoroughly inspected and undergo a multi-point quality check before listing. They are delivered clean, fully maintained, and free from major mechanical faults. Only original and tested parts are used. While vehicles are certified based on standard inspection criteria, no guarantee is provided for future performance. All vehicles are sold in their current condition (“as-is”), and it is the buyer’s responsibility to inspect the vehicle and clarify any concerns before completing the purchase. The dealership is not liable for any post-sale mechanical or electrical issues unless specifically covered under a warranty.
3. Customer Understanding & Support
  • At BUDGET CARS, we prioritize transparency and customer satisfaction throughout every stage of the purchase, sale, service, and support process. If a customer is unable to read, understand, or is unaware of the terms and conditions, our team ensures these are clearly explained in a language the customer is comfortable with. Our goal is to make sure every customer fully understands our process and feels confident in their decisions.
  • Customers are encouraged to ask us any questions related to vehicles, loans, purchase procedures, delivery timelines, service, or any other details. We are committed to providing complete guidance and support to ensure a smooth and trustworthy experience.
4. Warranty
  • All vehicles are sold “as-is” with a limited warranty of 6 months on the engine and gearbox, confirmed in writing at the time of sale. This warranty applies strictly to the engine and gearbox only. No other components, parts, or features of the vehicle are covered unless explicitly stated in writing in the sale agreement. All vehicles are sold on an “as-is” basis unless stated otherwise in a separate warranty agreement.
  • Customization services (seat covers, infotainment, polish, etc.) are optional and separately billed. Warranty for accessories is as per the respective manufacturer/supplier.
  • BUDGET CARS does not offer any implied warranties or guarantees regarding a vehicle’s performance, quality, or suitability for a particular purpose, beyond what is clearly stated in any limited warranty provided. Unless specifically mentioned in writing, we do not guarantee the following:
  • Condition: The vehicle may have visible signs of wear and tear such as scratches, dents, or other cosmetic imperfections typical of pre-owned vehicles. We do not claim the vehicle will look or feel like new.
  • Reliability: While we thoroughly inspect and inform customers of any known issues, we do not guarantee that the vehicle will operate without the need for future repairs or maintenance. Used vehicles may develop issues over time.
  • Use: We cannot ensure that the vehicle will be suitable for any specific use (such as long-distance travel, commercial purposes, or performance expectations) unless it has been clearly discussed and agreed upon in writing prior to the purchase.
5. Pricing, Payments and Deposits

BUDGET CARS reserves the right to modify these Pricing Terms and Conditions at any time without prior notice. It is the buyer’s responsibility to review and understand the applicable terms before making any booking or purchase.

5.1 Price Display and Validity
  • All prices listed on our website, showroom, catalogues, or platforms such as OLX, Facebook, Instagram, and YouTube are consistent and subject to change without prior notice. Prices are valid only at the time of inquiry and may vary based on market demand. However, once a customer books a vehicle and pays the booking or down payment amount, the price is locked and no further changes will be made. The listed price includes the cost of the vehicle in its current condition (“as-is”) and excludes registration, insurance, taxes, and RTO charges unless explicitly stated.
5.2 Negotiation and Final Offer
  • Vehicle prices may be negotiable depending on the condition of the vehicle, current market demand, ongoing offers, and the customer’s interest, knowledge, or bargaining ability. Any such adjustments are made at the discretion of the dealership during the discussion.
  • Final pricing is typically communicated verbally at the time of discussion; however, customers may request a written quotation or proforma invoice, which will be provided upon request and must be acknowledged before proceeding with the purchase.
5.3 Advance Payment / Booking Amount
  • A minimum non-refundable booking amount is required to hold the vehicle for inspection, documentation, or purchase processing.
  • Booking is valid for a limited number of working days, as specified by the owner or salesperson, from the date of payment. Failure to complete the full payment within this period may lead to cancellation of the booking and forfeiture of the booking amount.
  • We do not accept advances casually. A booking amount is only accepted when the customer selects a specific vehicle and confirms their intent to purchase within a timeframe discussed with the owner or salesperson. This amount is generally non-refundable, especially if the customer later discontinues communication, delays the decision without commitment, or fails to respond. However, if the customer genuinely does not like the vehicle and informs us within 7 days of payment, they may request a refund. Such requests are reviewed case-by-case and are subject to the discretion of the owner or salesperson.
5.4 Full Payment
  • Full payment must be completed before the delivery of the vehicle. This may include either the full vehicle amount or a down payment, as discussed and agreed upon at the time of purchase. If the customer is availing a loan, the down payment must be fully paid upfront, and loan approval must be confirmed before proceeding. Customers also have the option to pay the entire vehicle amount without financing. In either case, the vehicle will only be delivered, and ownership transferred, after 100% of the agreed payment is received.
  • Accepted payment modes include bank transfer, UPI, cheque (subject to clearance), and cash within legally permitted limits.
5.5 Inclusions and Exclusions
  • The sale price includes basic servicing, car washing, and internal quality checks. Add-ons like extended warranty, accessories, insurance, and registration are charged separately unless mentioned in the offer.
  • Test drives are available free of charge prior to booking confirmation, either by visiting the showroom in person or by requesting a test drive through our website.
5.6 Taxes and Government Charges
  • All government levies, taxes, and applicable RTO charges are to be borne by the buyer.
  • GST (if applicable) will be added to the sale price as per prevailing rates.
5.7 Price Match and Discount Policy
  • Any promotional discount or special offer must be availed within the offer period.
  • No retrospective discount, offer, or price match will be entertained after the invoice is raised.
6. Down Payment & Loan Policy
  • The down payment amount required for each vehicle will be clearly mentioned on our website or provided in full detail when you visit our showroom.
  • You may purchase a vehicle by paying the down payment, and loan options are available for most vehicles. However, for certain older vehicles, loans may not be available. This information will be clearly communicated either at the time of your visit to the showroom by our sales executive, staff member, or the owner.
  • The full down payment must be paid at the time of purchase. The remaining loan repayment will be based on the tenure and EMI amount as approved by the respective loan provider.
6.1 Financing & Loan Assistance
  • Financing options are available through partnered banks and NBFCs, subject to eligibility, documentation, and credit checks.
  • BUDGET CARS is not responsible for any delays, rejections, or decisions made by the financing institution.
  • All loan-related charges, including processing fees, interest rates, and down payment amounts, must be discussed separately and are to be borne by the buyer.
  • Customers are encouraged to review and understand the loan terms directly with the respective financial provider before proceeding. However, our team or the owner will be available to assist in explaining the terms and providing necessary information to help the customer make an informed decision before the purchase.
6.2 Financing & Loan Assistance
  • Financing options are available through partnered banks and NBFCs, subject to eligibility, documentation, and credit checks.

6.3 Loan Dues & Recovery Policy
  • In cases where a customer has pending loan dues and is unresponsive to follow-up calls or messages, the matter will be handled directly by the respective loan provider as per their legal recovery process.
  • At BUDGET CARS, we first attempt to inform the customer about the due payments through calls and messages. We also assist and guide them through the repayment process, provide necessary transaction support, and clarify any doubts they may have.
  • However, if the customer continues to remain unresponsive or avoids communication, the loan provider has the legal right to initiate recovery procedures, which may include repossessing the vehicle. If required, BUDGET CARS may support or assist in the recovery process.
7. Ownership Transfer
  • BUDGET CARS assists customers with the initiation and processing of ownership transfer, RC (Registration Certificate), RTO paperwork, and insurance documentation to ensure a smooth and hassle-free transition.
  • It is the buyer’s responsibility to complete registration and ensure all documents are submitted to the relevant RTO (Regional Transport Office).
  • Any applicable registration charges, road tax, insurance, or transfer fees are to be borne by the customer.
  • BUDGET CARS assists every customer in the smooth transfer of vehicle ownership. To initiate and complete the process, the customer must provide the necessary documents, such as:
  • Aadhaar card (for identity and address verification)
  • Basic personal details (such as name, address, contact number, etc.)
  • Any other documents as required by the local RTO (Regional Transport Office)
  • The customer is expected to cooperate fully by submitting the required documents and information on time. This cooperation ensures that the ownership transfer is processed without delays or issues.
  • The transfer process may take up to 10-30 working days from the date of full payment and submission of required documents.
8. Vehicle History, Documentation & Legitimacy
  • BUDGET CARS takes all reasonable steps to verify the authenticity and accuracy of vehicle documents. However, we do not guarantee the vehicle’s accident history, usage type (private or commercial), or potential mileage tampering unless explicitly disclosed.
  • We do not deal in vehicles that are stolen, illegal, 75 -100% accident-damaged, or involved in any criminal activity. Our commitment is to legal compliance and customer safety.
  • Vehicles with minor accident damage may be accepted only if they have been properly repaired, maintained, and inspected by our team. All relevant details are transparently shared with the customer to support informed decision-making.
  • Buyers are encouraged to conduct independent checks such as RC status, insurance history, and police records before purchase.
  • At BUDGET CARS, we ensure all documents involved in the buying and selling process are valid, accurate, and legally compliant.
  • When purchasing a vehicle from a customer, it is our responsibility to verify the authenticity of the documents.
  • When selling a vehicle to a customer, it is the customer’s responsibility to collect and confirm all relevant documents at the time of delivery.
  • If any document is found invalid or incorrect, we resolve the issue before completing the transaction to ensure a transparent and trustworthy experience.
9. Insurance Services
  • We offer vehicle insurance services through registered third-party providers. All final decisions regarding policy terms, claim approvals, or rejections lie solely with the insurer.
  • BUDGET CARS is not liable for any delays or rejections in insurance claims and encourages customers to carefully review policy terms before purchase.
  • If the customer chooses to purchase or renew vehicle insurance independently through an online platform, BUDGET CARS fully respects and accepts that decision. However, in such cases, the customer assumes sole responsibility for the insurance policy, including its accuracy, coverage, validity, and claim processes. BUDGET CARS holds no authority or liability in the event of any issues, claim rejections, or disputes arising from the independently purchased insurance.
10. Liability and Indemnification
  • BUDGET CARS is not liable for any future breakdowns, repairs, or damages after the sale is completed, except as covered under the limited warranty.
  • By completing the purchase, the customer agrees to take full responsibility for the vehicle and its usage after the sale is finalized.
  • This means that the customer will indemnify (protect) BUDGET CARS from any legal issues, financial liabilities, penalties, or operational problems that may arise after the ownership has been transferred. For example:
  • If the vehicle is involved in an accident, traffic violation, or illegal activity after the sale BUDGET CARS cannot be held responsible.
  • If the customer fails to renew insurance, pay fines, or update registration BUDGET CARS is not liable.
  • Once the vehicle is sold and handed over, all responsibility for its use, maintenance, and legal compliance belongs solely to the customer.
  • BUDGET CARS is not liable for any loss, damage, or injury arising directly or indirectly from the use of the vehicle.
  • Post-sale servicing, repairs, or modifications done by third parties are not covered under our policies.
11. Test Drive & Delivery
  • Test drives are available upon request and are subject to vehicle availability, location, and scheduling constraints.
  • The customer must carry a valid driving license and adhere to safety protocols during the test drive.
  • The customer shall be held liable for any damage, accident, or violation incurred during the test drive period.
  • Doorstep delivery is available for select pin codes only and may be subject to logistic feasibility.
  • Additional charges may apply for both delivery and test drives, depending on the location, distance from our showroom, and vehicle availability. These charges may vary case by case and are subject to change based on logistical factors.
  • Delivery timelines may vary due to unforeseen circumstances such as weather, traffic, or third-party logistics delays.
  • The customer must inspect the vehicle at the time of delivery and report any issues immediately; post-delivery claims will not be entertained unless covered under a specific warranty or agreement.
12. Dispute Resolution and Arbitration
  • Any disputes, claims, or legal matters arising out of or related to the purchase, sale, or services provided by BUDGET CARS shall first be attempted to be resolved amicably through mutual discussion.
  • If the dispute remains unresolved, it shall be referred to arbitration under the Indian Arbitration and Conciliation Act, 1996. The proceedings shall be conducted in Bangalore, India.
  • The arbitration tribunal shall consist of one arbitrator, appointed by BUDGET CARS.
  • The language of arbitration shall be English & Kannada and the proceedings shall remain confidential, except where disclosure is required by law.
  • Each party shall bear its own legal costs, and the decision of the arbitrator shall be final and binding on both parties.
  • All legal proceedings, if required, shall be subject to the exclusive jurisdiction of the courts in Bangalore, India.
13. Claims, Complaints, and Termination
  • All complaints related to the sale, purchase, or services provided by BUDGET CARS must be formally submitted to BUDGET CARS or its authorized partners within 30 days of availing the respective service. Claims submitted after this period may be rejected, and the customer may forfeit any right to compensation, resolution, or further consideration.
  • BUDGET CARS reserves the right to suspend or terminate your access to its sales and purchase, services at any time, at its sole discretion, if you are found to be in breach of any of the Terms and Conditions outlined herein.
  • Upon termination, these Terms shall expire, except for clauses intended to survive termination. All pending payments or dues must be cleared immediately upon termination.
14. Service Modification and Legal Jurisdiction

BUDGET CARS reserves the right to add, modify, suspend, or discontinue any part of its services, including purchase and sale offerings, at any time and without prior notice.

These Terms shall be governed by the laws of India, with exclusive jurisdiction belonging to the courts in Bangalore, Karnataka.
